Temporary Use: A temporary use is a use that is on a site between three days and three months.  Garden City Code 8-2C-38 regulates temporary uses.  If the use is more than three months or comes back to the same site after being removed it is considered a permanent use. If the use is longer than 3 months, it needs to go through the process of becoming a permanent use. A temporary use is processed as a new business.  Please refer to the link for a tutorial for new  or changing businesses.

Temporary Structure: Temporary structures are allowed for up to six months.  They can house a permanent use, such as providing shade for a wine bar, or a temporary use such as a fireworks stand. Temporary structures are governed by the International Building Code.

Required Documentation

Applications are required to be submitted on the city approved form(s). A link to the current forms is located here: link

The applications and forms most commonly associated with a Temporary Structure are:

  •  Building Permit for Temporary structure: Along with the application form, you will be required to submit an accurate, legible sketch of the site plan, tent floor plan, indicate fire extinguisher, and egress. This receive an expedited review (5-10 working days/ submittal), that does not need to go through the formal review process.  

  • Affidavit of Legal Interest

  • Resubmittal Form (for any resubmittals)

A typical temporary structure will incur the following fees:

  1. Admin set up
  2. Hourly Building Review Fee
  3. Hourly Building Inspection Fee
  4. Hourly Planning Review Fee
  5. Hourly Planning Inspection Fee
  6. Fire review
  7. Trades (plumbing, mechanical, electrical)  re separate through DOPL

Inspections

You will need to have a fire inspection, building, and planning inspection.

We are unable to schedule same day inspections. Inspections must be scheduled prior to 4:00 p.m. for next day inspections
